Frequently Asked Questions

To which relatives can I transfer my land using this law?+

The law exclusively authorizes the transfer to an ascendant or descendant of the owner, either by consanguinity or by affinity. This means that it covers fathers, mothers, sons, daughters, grandparents, grandchildren, fathers in law, and sons in law.

Can I freely sell the land resulting from the subdivision to a third party?+

Not at all. To avoid irregular subdivision or covert real estate speculation, the norm imposes an absolute prohibition on alienating the lot to third parties outside the family for a strict period of five years counted from the inscription.

Exactly what size must the resulting lots be?+

The piece detached for the benefited family member cannot have an area of less than 500 square meters or more than 1000 square meters, ensuring that the original lot continues to greatly exceed that measurement.
