The process is relentless but predictable. When you stop paying the CAE and the State is forced to pay the guarantee to the original bank that lent you the money, the TGR automatically becomes your new creditor. Unlike a private bank, TGR has extraordinary collection powers and does not need to ask a civil judge for permission in the traditional way to start pursuing your assets.
As a first measure of pressure, the Treasury massively informs all banks in Chile and the Commission for the Financial Market (CMF) looking for where you keep financial products. Whether it is a Current Account, a Vista Account or the RUT Account, if they find money in your name, they order the immediate retention of the balances they find, without prior notice.
The protective shield: what money is legally unattachable?
This is the most critical information you must handle. The TGR shoots "blindly" at bank accounts, but Chilean law (specifically article 445 of the Code of Civil Procedure and the regulations of the Labor Code) establishes strict limits on what the State can touch:
- Your Salary (Remuneration): Salary is sacred. The law establishes that workers' salaries cannot be seized up to the limit of 56 Development Units (UF). If the money that the bank froze corresponds to your employer's payment, that seizure is illegal and can quickly be "thrown away" in court.
- Pensions and Retirements: Funds deposited from old-age, disability, survivor or any retirement pensions also enjoy absolute legal protection against TGR seizures.
- The problem of independent workers: If you are independent (tickets) or have savings mixed with your salary in the same checking account, the defense becomes a little more complex. Since it is not a formal "salary" governed by the Labor Code, you will need to conclusively prove the nutritional origin of those funds.
